My sons father and I are not married. He signed the Birht Certificate but when we go it in the mail he was not on there. However I allowed him to claim our son so that he could claim head of house hold, on his taxes. Now our son is 3 and his father is  still not on his birth certificate.  Now we are having problems and i am thinking of leaving him. but want to make sure that i have legal custody or do i need to contact a lawyer.

HOW DO YOU KNOW HE SIGNED THE BIRTHCERTIFICATE???? HIS NAME SHOULD BE ON IT IF HE DID THE CORRECT PAPER WORK. i NOT SURE IF YOU PREPARE YOU OWN TAXES OR YOU HAVE SOMEONE ELSE DO IT BUT MOST PEOPLE WOULD VERIFY BY LOOKING AT THE BIRTH CERTIFICATE. THE SECOND THING I HAVE TO SAY IS THAT IF YOU HAVE NOT GONE THRU THE COURTS TO ESTABLISH CUSTODY THEN BOTH PARENTS HAVE EQUAL RIGHT TO THE CHILD.....FOR EXAMPLE IF YOU GUYS ARGUE AND HE TAKES THE CHILD AND BOTH PARENTS NAMES ARE OWN THE BIRTH CERTIFICATE WITH NO CUSTODY ESTABLISHED...THEN THATS LEGAL.......BUT IF HIS NAME ISNT ON THE BIRTH CERTIFICATE THEN HE CANT.........YOU SHOULD GO THRU THE COURTS IN YOUR AREA AN APPLY FOR SOLE CUSTODY......HE WILL PROBABLY FIGHT THAT AND YOU GUYS WILL IN UP IN COURT LETTING A JUDGE DECIDE.....I HOPE I WAS HELPFUL.... no we filled out the paperwork correctly. But he wasnt on the birth certificate. He was supposed to get it corrected but he never did. And he doesnt know that i am leaving yet and if i go thru the courts b4 everything is ready, it will result in big fight.

And he was with me and i saw him sign the birthcertificate.
